These Terms and Conditions apply to all tours, activities, experiences, programs and services booked with ExploreLosAndes Spa (“Explore Los Andes”, “we”, “us” or “our”), whether booked through our website, email, WhatsApp, direct communication or any other official sales channel.
By booking, paying for or participating in any service provided by Explore Los Andes, the customer confirms that they have read, understood and accepted these Terms and Conditions, together with our Cancellation & Refund Policy and Privacy Policy.
1. About Explore Los Andes
Explore Los Andes is a Chile-based tourism operator offering private, personalized and outdoor experiences, including but not limited to hiking, trekking, mountain activities, nature tours, snow activities, cultural experiences, multi-day programs and tailor-made travel services.
Many of our experiences take place in outdoor, mountain, snow, remote or natural environments. These activities may involve inherent risks and may be affected by weather, road conditions, access restrictions, safety considerations, physical condition, third-party availability or other operational factors.
2. Bookings and Confirmations
A booking may be requested through our website, email, WhatsApp, direct communication or any other official sales channel.
A booking is considered confirmed only once Explore Los Andes has accepted the booking request and the required payment, partial payment or deposit has been received, unless otherwise agreed in writing.
Some bookings may be confirmed through a partial payment or deposit. Unless otherwise stated in writing, the remaining balance must be paid no later than 48 hours before the tour start time.
Explore Los Andes may request payment of the remaining balance approximately one week before the tour date as part of our operational planning. However, the final deadline for payment remains 48 hours before the tour start time, unless a different deadline has been agreed in writing.
If the customer does not complete the remaining payment within the required timeframe, Explore Los Andes may cancel the booking and apply the applicable cancellation and refund conditions.
3. Prices and Payments
All prices are communicated through our website, official proposals, email, WhatsApp or other official sales channels. Prices may vary depending on the tour, season, number of participants, private service requirements, availability, third-party costs, currency, payment method or any custom adjustments requested by the customer.
Payments may be processed through external payment providers, bank transfer, PayPal, Stripe, WooCommerce Payments, Wise, Mercado Pago or other available payment methods.
Explore Los Andes does not store full credit card numbers or complete payment credentials on its own systems.
Payment processing fees, currency conversion charges, bank fees or international transaction fees may apply depending on the payment provider, country, currency and payment method used.
4. Cancellations, Refunds and Rescheduling
All cancellations, refunds and rescheduling requests are governed by our Cancellation & Refund Policy, which forms part of these Terms and Conditions.
Customers are responsible for reviewing the applicable cancellation and refund conditions before booking.
Cancellation, refund or rescheduling requests must be submitted in writing through one of our official communication channels.
5. Changes to Itineraries and Activities
Explore Los Andes makes reasonable efforts to operate each tour according to the agreed itinerary or description. However, itineraries, routes, schedules, activities, transportation, guides or logistics may be modified when necessary due to weather, safety, road conditions, access restrictions, park closures, snow conditions, avalanche risk, river levels, official restrictions, supplier availability, force majeure or any other operational reason.
If Explore Los Andes determines that an activity cannot be safely or properly operated as originally planned, we may modify the itinerary, change the route, adjust the schedule, offer an alternative activity, reschedule the service or cancel the activity according to the applicable policy.
Customer safety and responsible operation will always be prioritized over completing a specific itinerary, summit, route, viewpoint or activity objective.
6. Customer Responsibilities
Customers are responsible for providing complete, accurate and truthful information when booking or participating in a tour. This includes information related to physical condition, experience level, age, weight, health conditions, injuries, allergies, dietary restrictions, medication, special needs or any other factor that may affect participation or safety.
If the customer provides false, incomplete or misleading information, or fails to disclose relevant information, Explore Los Andes may modify the activity, adapt the itinerary, deny participation or cancel the service when necessary for safety or operational reasons.
Customers must follow the instructions of guides, staff, local operators, park authorities and official regulations at all times.
Customers must arrive on time, bring the required equipment and clothing, respect safety instructions, behave responsibly and avoid actions that may put themselves, other participants, guides, third parties, local communities or the environment at risk.
7. Physical Condition, Outdoor Risks and Safety
Some Explore Los Andes activities may require appropriate physical condition, suitable clothing, technical equipment, previous experience or the ability to walk, hike, climb, ski, travel at altitude or remain outdoors for extended periods.
Outdoor and mountain activities involve inherent risks, including but not limited to falls, slips, altitude effects, fatigue, weather exposure, cold, heat, snow, ice, rockfall, river crossings, road conditions, wildlife, remote access, limited communication and delayed emergency response.
By participating in an activity, the customer acknowledges that these risks may exist and agrees to follow all safety instructions provided by Explore Los Andes, its guides or authorized representatives.
Explore Los Andes reserves the right to refuse participation, modify an activity or stop a tour if a guide or company representative determines that a customer is not adequately prepared, does not have the required equipment, is under the influence of alcohol or drugs, behaves unsafely or presents a risk to themselves or others.
8. Equipment and Personal Items
Customers are responsible for bringing the clothing, footwear, personal equipment and personal items required for each activity, unless specific equipment is expressly included in the service.
Any included equipment will be described in the tour description, proposal or official communication.
Explore Los Andes is not responsible for loss, theft or damage to personal belongings, valuables, electronic devices, luggage, clothing or equipment during the tour, except where required by applicable law.
9. Third-Party Services
Some tours may include or require services provided by third parties, such as transportation companies, accommodation providers, national parks, ski resorts, thermal baths, refuges, restaurants, equipment rental providers, ticketing platforms, local guides or local operators.
These third-party services may have their own terms, conditions, restrictions, cancellation policies, safety rules and operating standards.
Explore Los Andes may coordinate or include third-party services as part of the customer’s experience, but we are not responsible for changes, delays, closures, restrictions, cancellations, penalties or service limitations imposed by third-party providers, except where required by applicable law.
10. Travel Insurance
We strongly recommend that all customers purchase travel insurance that covers trip cancellations, medical expenses, accidents, outdoor activities, mountain activities, evacuation, rescue, flight delays, lost luggage and other unexpected events.
Customers are responsible for ensuring that their insurance coverage is appropriate for the type of activity they book.
11. Minors
Minors must be accompanied by a responsible adult unless otherwise agreed in writing.
Parents, guardians or responsible adults are responsible for ensuring that minors are physically and emotionally prepared for the activity and that they follow all safety instructions.
Explore Los Andes may request age, height, weight, experience level or other relevant information when necessary to evaluate whether an activity is suitable for a minor.
12. Customer Conduct
Explore Los Andes expects all customers to behave respectfully toward guides, staff, other participants, local communities, suppliers, authorities, wildlife and the natural environment.
We may refuse service, remove a customer from an activity or cancel participation without refund if the customer behaves aggressively, irresponsibly, disrespectfully, illegally or in a way that compromises safety, the experience of others or the proper operation of the tour.
13. Photos, Videos and Promotional Material
Explore Los Andes may take photos or videos during tours for operational, safety, internal or promotional purposes.
If a customer does not want to appear in promotional photos or videos, they should inform Explore Los Andes in writing before the activity.
We will make reasonable efforts to respect such requests.
14. Website Information and Availability
We make reasonable efforts to keep the information on our website accurate and updated. However, tour descriptions, prices, availability, itineraries, inclusions, exclusions, schedules and conditions may change without prior notice due to operational, seasonal, supplier, safety or market factors.
In case of differences between website information and a specific written proposal or booking confirmation issued by Explore Los Andes, the written proposal or booking confirmation will apply to that specific booking.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Explore Los Andes shall not be liable for indirect, incidental, consequential or unexpected losses arising from delays, cancellations, itinerary changes, weather, force majeure, third-party actions, customer decisions, personal circumstances, travel disruptions or events beyond our reasonable control.
Nothing in these Terms and Conditions limits any mandatory rights that customers may have under applicable consumer protection laws.
16. Force Majeure
Explore Los Andes shall not be responsible for failure or delay in performing any service when such failure or delay is caused by events beyond our reasonable control, including but not limited to extreme weather, natural disasters, road closures, strikes, civil unrest, pandemics, government restrictions, park closures, accidents, emergencies, supplier failures, transportation disruptions or other force majeure events.
17. Privacy and Personal Data
Personal information provided by customers will be processed according to our Privacy Policy, which forms part of these Terms and Conditions.
By using our website, contacting us or booking our services, the customer acknowledges that personal information may be processed as necessary to manage inquiries, bookings, payments, logistics, customer service and legal or operational obligations.
18. Governing Law
These Terms and Conditions are governed by the laws of Chile.
Any dispute, claim or disagreement related to these Terms and Conditions, our services or any booking with Explore Los Andes shall be handled according to applicable Chilean law and competent authorities, without limiting any mandatory consumer rights that may apply.
19. Changes to These Terms and Conditions
Explore Los Andes may update these Terms and Conditions from time to time to reflect changes in our services, legal requirements, operational practices, payment methods, third-party providers or business policies.
The updated version will be published on this page with a revised “Last updated” date.
